📄 Terms & Conditions of AOS Mediators

These Terms and Conditions (“Terms”) govern your use of the intermediary services offered by AOS Mediators, operated by AOS Office (Govt Reg No: 100/2014, PAN: ABAFA1649L, GSTIN: 33ABAFA1649L1ZL). By accessing or using any of our services or interacting with us via our official channels (email, WhatsApp, phone, or in-person meetings), you agree to these Terms. If you do not agree, kindly refrain from engaging our services.
1. Legal Nature of Our Service
AOS Mediators acts solely as an intermediary between real estate buyers and sellers. We are not a broker, real estate agent, facilitator, or digital listing platform. We facilitate communication, arrange meetings, and coordinate engagement only between parties through our internal network and support systems. Our services are governed by the following Indian laws:
- Indian Contract Act, 1872
- Information Technology Act, 2000 (for digital communications)
- Real Estate (Regulation and Development) Act, 2016 (RERA)
- Applicable state laws regulating real estate transactions and intermediary services
All engagements are carried out only under a documented intermediary agreement entered into with either the buyer or the seller.
2. Scope of Services
AOS Mediators offers:
- Coordination between buyers and sellers
- Arranged sittings and meetings for negotiation
- Management and circulation of buyer/seller interest internally
- Commission processing based on success of transaction
We do not:
- Guarantee property ownership or legal title
- Mediate disputes or handle legal negotiations
- Act on behalf of any party in financial or legal matters
- Offer a property listing or browsing platform
3. Intermediary Commission Agreement
AOS Mediators enters into an Intermediary Commission Agreement with either the buyer or seller (but not both for the same transaction).
- A flat 2% of the final transaction value is charged as facilitation/intermediary commission.
- This commission is payable only upon successful completion of a sale or purchase.
- This commission is shared with registered brokers, agents, and lead providers who contributed to the transaction.
4. Third-Party Participation
AOS Mediators coordinates with third-party brokers, field agents, and local consultants. These entities are not employees or legal representatives of AOS Mediators. We ensure coordination but do not assume liability for their representations or conduct. All parties engaging with our registered brokers or agents are advised to conduct independent verification.
5. Confidentiality and Communication
- All buyer and seller information shared with us is treated with strict confidentiality.
- AOS Mediators communicates with parties only through verified channels: official email, WhatsApp, phone, or in-person sittings.
- Users are prohibited from circulating or misusing any information shared by AOS Mediators.
6. Disclaimer on Legal and Financial Documentation
AOS Mediators does not handle:
- Legal document verification
- Title search or encumbrance clearance
- Property measurement or land survey
- Financial payments, loans, or registration activities
We strongly advise all parties to engage their own legal counsel, real estate attorneys, surveyors, and registration agents to conduct independent due diligence.
7. Cyber Law Compliance
In accordance with the Information Technology Act, 2000, AOS Mediators maintains digital records and communication logs to ensure:
- Security of transaction-related communications
- Consent-based sharing of buyer/seller interest
- Prevention of spam, fraud, or impersonation
Any abuse of our digital channels or impersonation of our identity will lead to civil and criminal liability under Indian Cyber Laws.
8. Termination of Service
AOS Mediators reserves the right to:
- Deny services to any individual or entity without assigning a reason
- Terminate engagement if unethical, illegal, or fraudulent activity is suspected
- Withhold or retract commission if deal tampering or misrepresentation is identified
9. Limitation of Liability
AOS Mediators is not liable for any loss, damage, or dispute arising out of:
- Buyer/seller misrepresentation
- Legal flaws in property documentation
- Delay or failure of property registration
- Actions or inactions of third-party agents or brokers
Our liability is strictly limited to our role as an intermediary, as defined by Indian law.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of courts in Madurai, Tamil Nadu.
