📄 Terms & Conditions for Sellers — AOS Real Estate Mediators
Kindly read this Terms and conditions specifically meant for Sellers who deal with AOS real estate mediation services.

These Terms & Conditions (“Terms”) govern the relationship between AOS Mediators, operated by AOS  (Govt Reg No: 100/2014, PAN: ABAFA1649L, GSTIN: 33ABAFA1649L1ZL) and any Seller (“You/Seller”) who wishes to use our real estate intermediary services.
By communicating with AOS Mediators or signing an Intermediary Agreement, you agree to abide by these Terms.
1. Nature of Services
1.1 AOS Mediators acts strictly as a real estate intermediary, not as a broker, agent, or legal party to any property transaction.
1.2 We do not operate any public listing portal. Our services are human-driven and limited to:
- Coordinating buyer introductions through our internal and external network.
- Arranging sittings or meetings for negotiation.
- Providing neutral support during discussions.
1.3 We do not:
- Verify or guarantee property title or legal status.
- Negotiate final pricing on your behalf.
- Draft or register any legal agreements.
- Receive or transfer funds related to property sales.
2. Seller Obligations
2.1 Sellers must provide true and complete information about the property, including:
- Ownership documents, title status, encumbrances (if any).
- Price expectations, location, measurements.
- Any third-party rights or disputes affecting the property.
2.2 Sellers remain responsible for:
- Ensuring title is clear and marketable.
- Providing buyers with access for site visits or inspections.
- Using their own legal counsel for agreements, registration, and fund transfers.
3. Intermediary Commission
3.1 Sellers agree to pay AOS Mediators an intermediary commission of 2% (Two Percent) of the final transaction value, payable only upon successful deal closure with a buyer introduced by AOS Mediators.
3.2 The commission shall become due immediately upon:
- Signing a binding agreement to sell the property and
- Receipt of advance or part payment from the buyer.
3.3 The commission shall be paid by cheque, bank transfer, or any agreed method, within 7 (seven) days of signing the agreement and advance payment.
3.4 The intermediary commission is shared with any registered agent, broker, or lead provider who contributed to the successful sale.
4. Confidentiality
4.1 All seller details shared with AOS Mediators will be kept confidential and disclosed only to genuine, verified buyers within our network.
4.2 Sellers agree not to bypass AOS Mediators by dealing directly with any buyer introduced by us, without informing AOS Mediators.
Such circumvention shall make the seller liable to pay the full agreed commission.
5. Refund & Cancellation
5.1 No upfront payment is required.
5.2 If the seller withdraws after agreeing to sell or after accepting an advance, the seller remains liable for the full intermediary commission as damages.
6. Force Majeure
AOS Mediators shall not be liable for delays or failures caused by circumstances beyond our control, including but not limited to natural disasters, changes in law, civil unrest, or force majeure events.
7. Limitation of Liability
7.1 AOS Mediators shall not be responsible for:
- Any dispute between buyer and seller after final negotiation.
- Title defects, encumbrances, or legal disputes over the property.
- Losses due to misrepresentation by any party other than AOS Mediators.
7.2 Sellers shall indemnify AOS Mediators for any losses caused by false information provided by the seller.
8. Governing Law & Jurisdiction
These Terms shall be governed by Indian law. Any dispute shall first be resolved amicably; failing that, the courts at Madurai, Tamil Nadu shall have exclusive jurisdiction.
