📄 Terms & Conditions for Buyers — AOS Real Estate Mediators

These Terms & Conditions (“Terms”) govern the relationship between AOS Mediators, operated by AOS Office (Govt Reg No: 100/2014, PAN: ABAFA1649L, GSTIN: 33ABAFA1649L1ZL), and any Buyer (“You/Buyer”) who wishes to engage AOS Mediators for property purchase coordination in India.
By signing an Intermediary Agreement with AOS Mediators or using our services, you agree to these Terms.
1. Nature of Services
1.1. AOS Mediators acts strictly as an intermediary as per Indian Contract Act, 1872.
1.2. We do not operate as a real estate broker, agent, or online platform, and we do not represent either party as an agent under the Real Estate (Regulation and Development) Act, 2016 (RERA).
1.3. Our services are limited to:
- Collecting your property requirements.
- Coordinating matching sellers through internal broker/agent networks.
- Arranging sittings for face-to-face or online discussions.
- Providing follow-up coordination until you finalize the deal independently.
2. Intermediary Agreement & Commission
2.1. A written Intermediary Agreement must be signed before we initiate any lead sourcing or matchmaking.
2.2. AOS Mediators will charge a 2% facilitation/intermediary commission on the final transaction value upon successful deal closure.
2.3. This commission is payable directly to AOS Mediators only after the deal is concluded.
2.4. No advance or retainer is collected for property search.
3. Buyer Responsibilities
3.1. You must conduct independent due diligence, including:
- Title verification,
- Encumbrance checks,
- Legal compliance of documents,
- Physical site inspection, if needed.
3.2. AOS Mediators does not verify title or guarantee property status.
3.3. You shall handle all financial transactions, registration, and legal documentation with your own professionals.
4. Confidentiality & Use of Information
4.1. All property leads and seller information provided by AOS Mediators are confidential and for your use only.
4.2. You must not share, misuse, or circulate this information to third parties without written consent.
4.3. Any breach of confidentiality may result in termination of services.
5. Limitation of Liability
5.1. AOS Mediators shall not be responsible for:
- The legality of property titles or encumbrances.
- Misrepresentation by sellers, brokers, or third parties.
- Failure by buyer or seller to perform contractual obligations. 5.2. Our role ends at coordinating sittings and facilitating introductions.
5.3. We are not liable for any loss, dispute, or claim arising from your independent transaction.
6. Commission & Payment
6.1. You agree to pay the agreed 2% intermediary commission after the successful closing of the property transaction.
6.2. Payment shall be made in full within the time specified in your Intermediary Agreement.
6.3. If you close a transaction without notifying AOS Mediators or attempt to bypass our services, you remain liable for the full commission.
7. Dispute Resolution & Jurisdiction
7.1. Any dispute must first be attempted to resolve amicably through written notice to AOS Mediators.
7.2. Failing that, all disputes shall be governed by Indian law and fall under the exclusive jurisdiction of courts in Madurai, Tamil Nadu.
8. Acknowledgement
By proceeding with AOS Mediators, you acknowledge that:
- You have read and understood these Terms.
- You accept the limitations of AOS Mediators’ intermediary role.
- You shall comply with all applicable Indian real estate laws and regulations.
